Terms & Conditions

• You must be at least 18 years old and capable of forming a binding contract.
• You represent that registration information you provide is accurate and complete.

• Create an account to bid or sell.
• You are responsible for safeguarding your login credentials and all activity under your account.

• All auctions are conducted online-only.
• Bids are binding; winning bidders agree to purchase the item.
• “As-Is” Condition: Items are sold AS IS without warranty. Condition may vary (new, open box, used).
• Winning bidders will receive an invoice with payment instructions.

• Payments are due within 3 days of invoice date.
• Accepted methods: Stripe (Visa, MasterCard, Amex) and PayPal.
• Split payments up to 3 cards are allowed.
• Failure to pay may result in a 5% restocking fee, account strike/suspension, and loss of bidding privileges.

• Pickup within 7 days of auction close unless otherwise stated.
• Pickup requires government-issued ID and invoice QR code.
• Late pickups may incur a 1.5% daily storage fee or forfeiture without refund.
• Packaging/shipping may be available at additional cost but is not guaranteed.

• Sellers may drop off items or arrange pickup/on-site auctions for large assets.
• Payouts issued every 15 days via Stripe or PayPal, less fees.
• Items must be legally owned and free of liens or claims.
• Prohibited items include weapons, counterfeit goods, and illegal merchandise.

• Buyers may be charged a Buyer’s Premium (percentage added to winning bid).
• Sellers may be charged a Seller’s Premium (percentage deducted from sale proceeds).
• Additional fees may apply (restocking, packaging, storage, disposal).

• By using the Site, you consent to receiving promotional emails and remarketing ads (e.g., Google, Facebook).
• You may opt out of marketing emails at any time by clicking “unsubscribe.”

• We are not responsible for item condition, quality, or authenticity.
• We are not responsible for losses from late pickup, non-payment, or user error.
• We are not responsible for third-party services (Stripe, PayPal, carriers).
• Our liability is limited to amounts paid directly for the Services.

You agree to indemnify and hold harmless Arthur Nicolas LLC and its affiliates from any claims, damages, or expenses arising out of your use of the Services, your violation of these Terms, or your violation of third-party rights.

• We may suspend or terminate accounts for non-payment, fraud, violation of these Terms, or abuse of staff/services.

• These Terms are governed by the laws of the State of New Jersey (unless otherwise required by law).
• Disputes must be resolved in the courts of [Insert County], New Jersey.

We may update these Terms from time to time. Updates will be posted with a new Effective Date. Continued use of the Services constitutes acceptance of the updated Terms.
